These Terms & Conditions ('Terms') constitute a legally binding agreement between Body and Strength Pvt. Ltd. ('BodyandStrength,' 'Company,' 'we,' 'our,' or 'us') and every individual or entity accessing or using the BodyandStrength website ('Website' or 'Platform'), including customers, visitors, registered users, and any other person using the Platform ('User,' 'you,' or 'your').

These Terms govern your access to and use of the Platform, including browsing products, creating an account, placing orders, purchasing products, accessing content, participating in promotions, and using any services offered through the Platform.

By accessing or using the Platform, you confirm that you have the legal capacity to enter into a binding agreement under applicable laws and agree to comply with these Terms and all applicable laws and regulations.

By accessing or using the Platform, you represent and warrant that:

• You are at least 18 years of age or have attained the age of majority under the laws applicable to your jurisdiction.
• You possess the legal capacity and authority to enter into a binding agreement.
• You will use the Platform only for lawful purposes and in accordance with these Terms.
• All information provided by you is accurate, complete, and kept up to date.
• If you are using the Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you are authorised to bind that entity to these Terms.

BodyandStrength is entitled to suspend, restrict, or terminate access to the Platform if it reasonably believes that a User does not satisfy the eligibility requirements or has provided false, misleading, or incomplete information.

Certain features of the Platform may require you to create and maintain a registered Account. When creating an Account, you agree to:

• provide accurate, current, and complete information;
• promptly update your information whenever necessary;
• maintain the confidentiality of your login credentials;
• take reasonable measures to prevent unauthorised access to your account; and
• notify BodyandStrength immediately of any suspected unauthorised use or security breach involving your account.

You are responsible for all activities, until you notify BodyandStrength of unauthorised access, conducted through your Account, whether or not authorised by you, unless such activities result directly from BodyandStrength's negligence or failure to maintain reasonable security measures.

BodyandStrength reserves the right to refuse registration, suspend, restrict, or terminate any Account that:

• violates these terms;
• is used for fraudulent, unlawful, or abusive purposes;
• contains false or misleading information; or
• poses a risk to the security, integrity, or proper functioning of the platform.

Termination or suspension of an Account does not affect any rights or obligations arising before such suspension or termination.

BodyandStrength operates an online platform offering a range of health, nutrition, fitness, wellness, and lifestyle products to customers. The Platform may feature Products sold directly by BodyandStrength as well as Products offered by third-party brands or other authorised sellers, depending on the nature of the Product listing.

BodyandStrength endeavours to ensure that Product listings are accurate, complete, and regularly updated. However, Product availability, specifications, pricing, packaging, ingredients, nutritional information, images, and other Product-related details may change from time to time due to manufacturer updates, inventory changes, or other operational reasons.

Where Products are supplied by third-party brands or sellers, certain obligations relating to product warranties, manufacturing defects, product quality, or after-sales support may be governed by the applicable manufacturer or seller policies, subject to applicable consumer protection laws.

BodyandStrength will make reasonable efforts to facilitate customer support and assist in resolving customer concerns; however, the resolution of certain claims may depend on the applicable seller's or manufacturer's policies and procedures.

The inclusion of any Product or brand on the Platform does not constitute an endorsement, guarantee, or certification by BodyandStrength unless expressly stated.

BodyandStrength reserves the right to add, modify, discontinue, or remove any Product, service, category, feature, or functionality available on the Platform at any time without prior notice.

BodyandStrength strives to present accurate and up-to-date information regarding all Products available on the Platform. Product descriptions, specifications, pricing, nutritional information, ingredients, images, packaging, availability, and other related content are provided for general informational purposes and may be updated without prior notice.

While reasonable efforts are made to ensure accuracy, BodyandStrength does not warrant that all Product information is complete, current, or free from errors. Manufacturers may revise product formulations, packaging, labelling, or specifications from time to time, and such changes may not always be immediately reflected on the Platform.

Product images are provided for illustrative purposes only. Actual Products, packaging, colours, labels, sizes, or appearances may vary from those displayed on the Platform.

All Products are subject to availability. Adding a Product to your cart or submitting an Order does not guarantee that the Product is available for purchase.

If a Product becomes unavailable after an Order is placed, BodyandStrength may cancel the affected Order or, where appropriate, offer a suitable alternative or process a refund in accordance with the applicable policies.

BodyandStrength may also limit purchase quantities, discontinue Products, modify Product offerings, or restrict sales where necessary to comply with legal, operational, inventory, or business requirements.

All prices displayed on the Platform are stated in Indian Rupees (INR) unless otherwise specified and are subject to applicable taxes, duties, levies, and charges as required under applicable law.

BodyandStrength makes reasonable efforts to ensure that Product prices and promotional offers displayed on the Platform are accurate. However, inadvertent pricing errors, typographical mistakes, or technical inaccuracies may occur.

If an error is identified, BodyandStrength may, at its discretion and subject to applicable law, correct the error, revise the applicable price, or cancel the affected Order, even if payment has already been initiated or received.

Where an Order is cancelled due to a pricing error after payment has been successfully processed, the amount paid for the affected Order will be refunded in accordance with the applicable Return, Refund & Replacement Policy.

Payment for Orders may be made using the payment methods made available on the Platform from time to time. By submitting payment information, you represent and warrant that you are authorised to use the selected payment method.

BodyandStrength does not store complete payment card details on its systems. Electronic payments are processed through authorised third-party payment service providers that employ industry-standard security measures.

BodyandStrength reserves the right to refuse, suspend, or cancel any transaction that appears to be fraudulent, unauthorised, suspicious, or in violation of these Terms or applicable law.

The placement of an Order on the Platform constitutes an offer by you to purchase the selected Products subject to these Terms.

An Order shall be deemed accepted only when BodyandStrength confirms the Order for processing or dispatch. An order confirmation acknowledging receipt of your Order does not constitute acceptance and serves only as confirmation that your Order request has been received. An Order may be subject to verification, including payment authorization, product availability, and fraud prevention checks before acceptance.

BodyandStrength may refuse or cancel any Order, in whole or in part, for reasons including but not limited to:

• Product unavailability;
• pricing or technical errors;
• suspected fraud or unauthorised transactions;
• inaccuracies in customer information;
• legal or regulatory restrictions; or
• any other legitimate operational reason.

Customers are responsible for ensuring that all Order details, including shipping address, contact information, and selected Products, are accurate before completing the purchase.

BodyandStrength offers shipping services in accordance with its Shipping Policy.

Estimated dispatch and delivery timelines provided on the Platform are indicative only and may vary depending on factors such as product availability, delivery location, courier operations, weather conditions, public holidays, force majeure events, or other circumstances beyond BodyandStrength's reasonable control.

Customers are responsible for providing complete and accurate shipping information. BodyandStrength shall not be responsible for delays, failed deliveries, or additional costs resulting from incorrect or incomplete delivery information provided by the Customer.

Detailed information regarding shipping methods, delivery timelines, shipping charges, courier partners, tracking, delivery attempts, and related matters is available in the BodyandStrength Shipping Policy, which forms part of these Terms.

BodyandStrength aims to provide a fair and transparent process for returns, refunds, and replacements, subject to the eligibility criteria and conditions specified in its Return, Refund & Replacement Policy.

Eligibility for returns, refunds, replacements, cancellations, damaged or defective products, incorrect deliveries, non-returnable items, refund timelines, and related procedures shall be governed exclusively by the applicable Return, Refund & Replacement Policy.

Users are encouraged to review the Return, Refund & Replacement Policy before placing an Order to understand their rights, responsibilities, and the conditions applicable to returns and refunds.

All intellectual property rights in and to the Platform, including but not limited to its design, layout, software, source code, text, graphics, logos, trademarks, service marks, trade names, product images, videos, photographs, audio, databases, downloadable materials, blog content, and other proprietary content, are owned by or licensed to BodyandStrength and are protected under applicable intellectual property laws.

Except as expressly permitted by these Terms or with BodyandStrength's prior written consent, you may not copy, reproduce, distribute, modify, publish, transmit, display, create derivative works from, reverse engineer, or otherwise exploit any part of the Platform or its content for commercial purposes.

Nothing contained in these Terms shall be construed as granting any licence or right to use any intellectual property belonging to BodyandStrength or its licensors, except for the limited right to access and use the Platform for lawful personal and non-commercial purposes.

Unauthorised use may result in civil and criminal remedies available under applicable law.

When using the Platform, you agree not to:

• violate any applicable law or regulation;
• infringe the intellectual property or other rights of any person or entity;
• provide false, misleading, or fraudulent information;
• create multiple Accounts for deceptive or abusive purposes;
• interfere with the operation, security, or integrity of the platform;
• introduce viruses, malware, malicious code, or other harmful technologies;
• attempt to gain unauthorised access to the Platform, its servers, databases, or networks;
• use automated tools, bots, scripts, crawlers, or scraping technologies without authorization;
• impersonate another individual or entity;
• post unlawful, defamatory, obscene, abusive, discriminatory, or offensive content;
• manipulate reviews, ratings, promotions, or pricing;
• engage in fraudulent transactions or payment abuse; or
• use the Platform in any manner that could disrupt, damage, overburden, or impair its normal functioning.

BodyandStrength reserves the right to investigate suspected violations of these Terms and may suspend or terminate access to the Platform, cancel Orders, remove content, or take any other action it considers appropriate, subject to applicable law.

BodyandStrength may provide features that allow Users to submit reviews, ratings, feedback, comments, suggestions, testimonials, questions, or other content ('User Content') relating to Products, Services, or their experience with the Platform.

By submitting User Content, you represent and warrant that:

• the content is accurate and based on your genuine experience;
• you own or have the necessary rights and permissions to submit such content;
• the content does not infringe the intellectual property, privacy, publicity, or other legal rights of any third party;
• the content does not contain false, misleading, defamatory, obscene, abusive, discriminatory, unlawful, or otherwise objectionable material; and
• the content complies with these Terms and all applicable laws.

By submitting User Content, you grant BodyandStrength a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, publish, modify, adapt, translate, distribute, display, and otherwise utilize such User Content for the purpose of operating, promoting, improving, or marketing the Platform and its Products or Services, subject to applicable law.

BodyandStrength does not endorse or guarantee the accuracy of User Content submitted by Users and reserves the right, but not the obligation, to monitor, review, edit, refuse, or remove any User Content that it reasonably believes violates these Terms, applicable law, or the rights of any third party.

The Platform may contain links to third-party websites, applications, products, services, advertisements, or other resources that are not owned, operated, or controlled by BodyandStrength.

These links are provided solely for the convenience of Users and do not constitute an endorsement, recommendation, sponsorship, or approval of any third-party website, product, or service unless expressly stated.

BodyandStrength is not responsible for the availability, accuracy, content, security, privacy practices, or business practices of any third-party website or service. Your interactions with any third-party website or service are solely between you and the applicable third party and are governed by their respective terms and policies.

Users are encouraged to review the applicable terms, privacy policies, and other legal documents of any third-party website before using its services or sharing personal information.

The Products and information made available on the Platform are intended for general informational and educational purposes only.

Any information relating to nutrition, fitness, health, wellness, dietary supplements, exercise, or lifestyle should not be interpreted as medical advice, diagnosis, treatment, or a substitute for professional healthcare consultation.

Nothing contained in these Terms excludes or limits any rights that cannot be lawfully excluded under applicable consumer protection laws.

To the fullest extent permitted by applicable law, BodyandStrength, its directors, officers, employees, affiliates, representatives, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, goodwill, business opportunities, data, or other intangible losses arising out of or relating to:

• unauthorised access to or alteration of your information;

• any event beyond BodyandStrength's reasonable control.

Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited under applicable law, including liability arising from fraud, wilful misconduct, or gross negligence where applicable. Nothing in these Terms is intended to limit or exclude any statutory rights or remedies available to consumers under applicable law.

You agree to indemnify, defend, and hold harmless BodyandStrength, its affiliates, directors, officers, employees, representatives, licensors, service providers, successors, and assigns from and against any claims, actions, proceedings, liabilities, losses, damages, costs, expenses, or reasonable legal fees arising out of or relating to:

• your breach of these Terms;
• your misuse of the Platform;

• any User Content submitted by you.

BodyandStrength reserves the right to assume the exclusive defence and control of any matter subject to indemnification, and you agree to cooperate with BodyandStrength in the defence of such claims.

BodyandStrength may suspend, restrict, or terminate your access to the Platform or your Account, with or without prior notice, where it reasonably believes that:

• you have violated these Terms;
• fraudulent, unauthorised, or unlawful activity has occurred;
• your actions may compromise the security, integrity, or operation of the Platform;
• continued access may expose BodyandStrength or other Users to legal, financial, or operational risk; or
• suspension or termination is required under applicable law.

Termination or suspension shall not affect any rights, obligations, liabilities, or remedies that accrued before such termination.

Users may discontinue using the Platform or request closure of their Account at any time, subject to any pending Orders, payment obligations, or legal requirements.

BodyandStrength respects the privacy of its Users and is committed to protecting Personal Information in accordance with applicable law.

The collection, use, storage, disclosure, processing, and protection of Personal Information are governed by the BodyandStrength Privacy Policy, which forms an integral part of these Terms.

By using the Platform, you acknowledge that you have read and understood the Privacy Policy and consent to the processing of your information in accordance with that Policy and applicable law.

BodyandStrength may revise, modify, update, or replace these Terms from time to time to reflect changes in applicable law, business practices, technology, operational requirements, or the services offered through the Platform.

Updated Terms will be published on the Platform together with the revised effective date, unless otherwise required by applicable law.

Your continued use of the Platform after the revised Terms become effective constitutes your acceptance of the updated Terms.

If you do not agree with any revised Terms, you should discontinue using the Platform.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, claim, controversy, or difference arising out of or relating to these Terms, the Platform, or any Products or Services shall, to the extent possible, first be resolved through good-faith discussions between the parties.

If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, unless otherwise required by applicable law.

If any provision of these Terms is held to be invalid, unlawful, unenforceable, or ineffective by a court or competent authority, such provision shall be deemed severed to the extent necessary, and the remaining provisions shall continue in full force and effect.

Failure by BodyandStrength to enforce any provision of these Terms shall not constitute a waiver of any right or remedy available under these Terms or applicable law.

BodyandStrength shall not be liable for any delay, interruption, failure, or inability to perform any obligation under these Terms where such delay or failure results from events beyond its reasonable control, including natural disasters, floods, fires, epidemics, pandemics, governmental actions, war, terrorism, civil unrest, strikes, labour disputes, power failures, internet or telecommunications disruptions, transportation interruptions, or other force majeure events.

Where reasonably practicable, BodyandStrength will make reasonable efforts to minimize the impact of such events and resume normal operations as soon as practicable.
